City Council Meeting 8/12/08

After a 3 week hiatus, the Lowell City Council is meeting tonight. The agenda is packed but there are only a few Councilor motions; two standout.

The first is by CC J. Milinazzo. He is requesting that the CC begins “the annual review/evaluation of the City Manager.” There is a City ordinance which requires each City Councilor to give his/her evaluation of the City Manager. Jennifer Meyers’ article in the August 8th edition of the Sun does a good job of giving the backstory, “City Manager Bernie Lynch has been on the job for two years, but unlike other city employees has not seen a pay increase. What’s more, it’s possible he won’t see one for the remainder of his contract, which expires in July 2010.” By the way, Meyers is doing a very good job in covering City Hall. It appears that she has been assigned to the Mike Lafleur’s old beat.

And the other Councilor motion that grabbed my attention was from CC A. Kazanjian: “Reqests the City Council meet in executive session with the Arena Commission to discuss the Arena.” I am not sure what this is about. It could be regarding the Arena’s management contract. If that is the case, doesn’t that fall under the City Manager’s responsibility? Plan E form of government does not give the City Council authority to negotiate except with the three individuals that report to them. They have to hear the recommendation and then vote up or down. Well, I could be wrong.

    I didn’t see it but I am told the CC went into executive session to discuss DRA. What is DRA?

    Mimi you’re correct. If you read Plan E, section 108 bars the City Council from this type of activity. It’s the role of the City Manager to negotiate on behalf of the City and the council to ratify certain contracts/appointments but not all. But of course, what does Alan “conflict of interest” Kazanjian care? The rules don’t apply to him.

    From my recollection, due to special legislation, it is actally the role of the Arena and Civic Stadium Commission to negotiate this contract. The Legislature created the Commission to give the University some say in what happens at the facility since they are a stakeholder and the state contributed 20M plus 4M via the University and the city just 4M. I really don’t know what role the City Manager or the Council has in this if any.

    It’s time to pass the burden of the Arena on to the University. They are better equipped to handle the annual deficit. It will be passed on to all of the residents of MA through our state taxes instead of just the residents of Lowell through our property taxes. UMass Amherst has the Mullins Center and they run it and whatever deficit they have (if they have one) is absorbed by the University. Lowell needs to get out from under this white elephant. At that time the Lowell sun and the consultant on the project (Bill Taupier) said it was “going to make money”. Like they say, there’s one born every minute.

    getting into negotions with arena matters, its really the CM

    job to negoiate, not conncillor towtruck

    Moonlight, can you mitigate your comments a bit please? I am as unhappy with C. Kazanjian as much as anyone, but you undermine your own point and border on being banned when you use names like that.

    Kami, you make some compelling arguments for letting the Arena go to UML. Interesting.

    Councilor K and some of his cronies have lost my vote and that of many of the residents of Middlesex Village when they oh so casually approved declaring surplus the land at 1769 Middlesex Street last night. ( Site of the proposed Walgreens) These are the same people who came around before the election and told us that it was not a good place for that. After all, it is only the third worst insection in that STATE. We are already getting stuck with a new plaze on Middlesex Street, another one proposed for the Wood/Middlesex corner and 127 new condos also on Middlesex. We are all waiting for the day an emergency vechicle cannot get through due toi the congestion we have in the morning and in the late afternoon.

    Have to love the Sun headline “Man used bogus info to gain city tow contract” Maybe in there rush to get the story published they got the two brothers mixed up. Getting to the point. To have people working for you and not having Workmans Comp.Insurance for them is not only a crime tis a sin. Don’t matter whom was plowing with his equiptment,unless they had Afflack they were on thier own.
    I deal with legal documents all day at work. The first thing you do is to look real close at the papers to be sure of there authenticity. White-out is allowed on the rare occasion with both parties initilizing the change and the a new document is issued. So he altered the insurance policy,scanned it into his computer and then had a so called assistant(female of course) send it to the city. Right! Wonder if this is the first time? Last but not least I thank the parties involved in this case to have not swept it under the rug. Let the chips fall where they may.
