DA Investigation into Kazanjian

by at 11:34 am.

The Sun has the breaking news:

District Attorney Gerard T. Leone has subpoenaed city records related to dozens of properties and businesses either owned or developed by City Councilor Alan Kazanjian, The Sun has learned.

The subpoena is dated Sept. 28. It is signed by Assistant District Attorney Doug Cannon and was addressed to Solicitor Christine O’Connor.

More details at the link.

This could be pretty huge.

  1. Jack Mitchell Says:

Only in America. Ladies and Gentlemen, I humbly present to you from the District of Columbia Council, Ward 8, Marion Barry.

  2. Kim Says:

I think this makes for a good quote right now from Mr. Milinazzo-

“I would also like to thank Councilor Alan Kazanjian for saying what I really perceive to be one of the nicest things he’s said to me, that he’s ashamed that I’m his colleague because I really truly believe that he doesn’t have the best interest of the city as a city councilor and I think he’s proven that time and time again. So if he’s ashamed of me, I’ve proven my point of being a good city councilor. Thank you.”

  3. MOONLIGHT Says:

Come on councillor towtruck–resign give it up
and take armand and rita with you.

  4. Dan M Says:

Is it possible he will be re-elected if he doesn’t resign or isn’t removed?

  5. Gerry Nutter Says:

I’d say he will get re-elected if he doesn’t resign. There will be no indictments before the election and the Councilor doesn’t strike me as the type of guy who would resign.

Unfortunately people vote a lot by name recognition, be that good or bad press..

  6. Bob Forrant Says:

I agree with GN that it would appear that he will be re-elected absent a large, large turn out of new voters unimpressed with orange signs everywhere!

  7. Jack Mitchell Says:

Bob, How many new voters do ya think we need? Let’s haggle.

  8. Lynne Says:

I think there’s a chance he goes down in flames in this upcoming election, and a chance he might get reelected albeit NOT anywhere near the top of the ticket.

Keep in mind that a majority voters appear to be thinking “not one incumbent!” I’ve heard that from a multitude of campaign sources. (I do hope that people like a *few* incumbents!)

Alan’s votes were capped as of last election. I don’t believe he’s gained any more since. He’s only lost support. It only takes a drop of a few hundred to go from fourth to tenth, remember.

Couple that with any increased turnout (Fair Vote, Move Lowell Forward, others, will all be targeting new local voters) and Kazanjian is in trouble, make no mistake. However, it would not do to make the assumption that he is unreelectable.

  9. Fran McDougall Says:

KRS. He knew something we didn’t know. Great news.

  10. Prince Charming Says:

Rodney’s gonna lose his fifth vote. Boooo hooooo hooo.

  11. Mimi Says:

I thought the investigation had to do with the Inspection office. Why is a charitable foundation on the list? That suggests that this investigation may much broader than gas and plumbing permits.

    And PC:
You know better than anyone that Rodney never had their four vote. He did not lose what he never had.

  12. Laura Says:

At my job, I’ve had to respond to a subpoena on behalf of my agency for a very small investigation: one client for a 12 month period of time. It took a few hours of my time and my bookkeeper’s time and none of the files had yet been archived.

This subpoena goes back 9 years for 12 city departments and covers 15 different entities. This is going to take the time of many, many city employees and many, many hours digging through archived files, redacting information that isn’t pertinent to the investigation (for example, bank statements showing canceled checks need to have the checks that aren’t relevant redacted), photocopying all the documents… Plus, they have 2 weeks to respond.

I’d like to bet that city employees are also scrambling to submit their first report that needs to go to the federal government for the stimulus money they’ve gotten. (That’s due this week and my experience with stimulus money is that reporting is stringent.)

Yeah… Kazanjian is costing the taxpayers LOTS of time and money with this investigation. He needs to apologize and resign.

  13. TPetty Says:

Kazanjian won’t resign so it’s up to Lowellians to vote him the heck out of office. If he wins a second term … shame on us!

  14. joe from Lowell Says:

What if we went door to door urging people not to vote for him? Hand people a pile of clippings, instead of campaign literature?

All over the Highlands. Think that would work?

  15. Nancy T Says:

He will not resign and he will be re-elected….. this group does not have the politcal clout that he does……. He will get his people out to the polls and your group has not been very successful getting the voters out in past elections. Lets just hope people that do go out to vote see what is going on and do the right thing on Nov 3.

  16. The Mark Says:

Two words: Chuck Freakin’ Turner. If that can happen in Boston, CC Kazanjian can get re-elected here. There are a whole lot of Orange and Blue signs in the Highlands and lower Centralville right now.

  17. Gogetter Says:

why hasn’t Broderick been investigated? Maybe someone should also check into Franky Decouteaux’s back taxes and parking tickets that she doesn’t like to pay!

  18. Gogetter Says:

He is innocent until proven guilty people!! Why should he resign?

  19. Observant One Says:

Sadly, those who prognosticate a successful re-election for Councilor Kazanjian are probably right. However, it has to be realized that he is in a position to throw far more money at the effort than most candidates are able. I also know as fact (yes, fact) that he pays his sign holders. Not sure if this is disclosed on his campaign financials, but I know that he does it.

  20. Mr. Lynne Says:

    “Chuck Freakin’ Turner.”

Actually I was thinking of Buddy from Providence.

  21. The Mark Says:

    Obi One (get it?),

Wow, that’s pretty damning stuff there. Can you prove it? I know this is Lynne and Mimi’s corner of the interwebs but they are historically pretty tough on those making personal attacks and throwing around baseless allegations. Can you tell us a little more to prove your not a plant or someone with an axe to grind?

  22. The Mark Says:

    Chris,

You can think whomever you like- my point was Chuck “Superfly” Turner was lead OUT OF CITY HALL IN HANDCUFFS and still smoked his challengers. My point is right now whatever we assume is going on with CC Kazanjian is still up in the air as no formal charges have been filed nor any arrests made to my knowledge.

  23. Mr. Lynne Says:

I wasn’t disputing anything. I was just that Buddy was the first thing that popped into my head when the question came up about the possibility of him getting reelected while under investigation.

  24. The Mark Says:

Nor was I Chris. Just when one gets arrested at City Hall and still wins after the fact that sticks in my head a smidge more then being under investigation (allegedly).

  25. Mr. Lynne Says:

    Indeed TM.

I’m getting a chuckle responding to comments that use my real name. I had to double check it was meant for me just to be sure. ;)

It’s funny… I chose the nick when I first started commenting on this blog so that it’d disclose my potential bias each time without my having to say it over and over again. Now I use it everywhere.

  26. The Mark Says:

I could but I won’t respond with something witty but it’s admittedly really mean, even the boys at MMC have some type of filter and we can choose to use it sometimes.

  27. Maggie Says:

Goguette - Are you serious about Descoteaux - because that could change ny whole opinion of her.

  28. Mr. Lynne Says:

I’d like to see anything anyone has to support a back tax issue or a parking ticket issue. Haven’t heard anything about it until now.

Of course previously there were accusations on this blog about her paying people under the table which the Mambo manager roundly refuted. I think there are people in this city that are willing to make stuff up here. People came out raising issues around her ‘immigrant’ status (total lie) and when that didn’t were there was the ‘blow-in’ argument.

There was a post on the campaign response to all this crap here.

It seems there are people in this city that are willing to make stuff up here. So if you think there is a tax issue, I’d like to see some evidence otherwise it’s dismissible.

  29. Observant One Says:

The Mark: Is it “damning stuff”? I’m very sure of the facts but am not aware of any legal issues with candidates paying street corner sign holders. Maybe you can enlighten us.

Not baseless, not a plant and not someone with an “axe to grind” - whatever that means. But I do admit that I do not like him at all and would be very pleased (no, ecstatic) if he would resign. The sooner, the better in my opinion. I never was comfortable having a lawbreaker as my lawmaker. And, yes, I have held that opinion since back to when he ruled the Zoning Board of Appeals as Chairman. I always considered his ZBA position to present a glaring conflict of interest and, as such, was quite vociferous in my protests to various city officials at that time.

Ironically, during the last election, I had actually commented to people that he must be paying his sign holders. No facts to support it at that time but he had such a committed army of very aggressive sign holders that it just led me to assume that they had to be motivated by something beyond loyalty and friendship.

Assuming that those who state that the candidates with the most signs wins, than I can only assume that CC Kazanjian may very well win again.

  30. Eleanor Rigby Says:

    Maggie asked
“Goguette - Are you serious about Descoteaux - because that could change ny whole opinion of her.”

Or it could be a plant like the one that she wasn’t an American when she first announced for office. The gang of six sees her as a serious threat. You could always call the treasurers office and ask.

  31. Eleanor Rigby Says:

Maggie, for the record I just did a search of LowellDeeds dot com to see if there was anything outstanding registered (the city would do that if it were in tax title or had placed a lien against her property) and there is nothing listed beyond their mortgage and deed.

So I would say at this point that unless he can prove what he is saying, Gogetter is a troll planted by someone concerned for their future.

  32. Maggie Says:

Thanks Eleanor R - I appreciate the info. No matter how good someone may appear to be - if they have tax or parking tickets issues ,0 I would not vote for them - so you have just cleared the air.

  33. Prince Charming Says:

Now it appears that Armand has the “whine Flu”. Funny how whispers of indictments of close friends and colleagues, as well as the possible demise of the SAC Club can affect one’s health.

  34. openyoureyes Says:

joe from lowell I think you have a great idea to hurt Kazanjian by handing out clippings door to door and sadly that is exactly the point. When nothing comes of this “investigation” I wonder if the Scum will run the headline “Nothing Found” and when will information come out about the McBee investigation my guess it will be after the election. It is my understanding the paper had this story for several days and wanted to hold it closer to the election, but when Chris Scott was seen with a copy of the subponea (which is quite curious) they decided to run it quick. Please people OPEN YOUR EYES. Mr. Burns a.k.a. Kendall Wallace is manipulating it all from his perch high above the nuclear power plant. In order to control the council they must get rid of at least one councilor and they smell the blood in the water with Kazanjian (perhaps rightfully so.) I heard the same thing that Gogetter mentioned about Descouteaux parking tickets that have been allegedly “fixed” The Scum knows it, but god forbid they write it about the person they handpicked from the beginning. Is anybody looking into the LHA permit fiasco or is a real scandal too uncomfortable. By the way I admit I was wrong when I posted the city was owed 20,000 in permit fees by the LHA and the manager looked the other way it was 200,000 sorry for dropping the 0 like an unpaid parking ticket.

  35. Eleanor Rigby Says:

Openyoureyes I say this to you and Gogetter. If you have information that Descouteaux is a tax scoflaw then come forward with it. “Hearing” it, passing along the rumor, doesn’t cut it.

If she is a tax scoflaw then we the voters have a right to know, if she is the target of a mud slinging campaign we need to know that as well.

    Time to put up boys!

  36. Mr. Lynne Says:

“…when Chris Scott was seen with a copy of the subponea (which is quite curious) they decided to run it quick.”

It’s called news reporting. The subpoena is a story. Are your really suggesting that the responsible thing to do would have been to sit on it? Wow.

    “…I heard the same thing”

Yeah, and I heard that 9/11 was an inside job! Put up people.

  37. Gerry Nutter Says:

Why put up real facts when they don’t put up their real name and hide behind a made up name on a blog and not have to admit who they are?

I’m of the opinion that if you want to write something, then put your name to it. Don’t hide behind a Eleanor Rigby or Openyoureyes nickname for fear of pissing people off. I’ll let you know who I am and what I think.

People who throw mud and pass along rumors about candidates who don’t have the guts or backbone to put their name to it are as credible as a National Enquirer reporter..wait the National Enquirer reporter probably is more credible.

  38. outsider Says:

This is exactly what I have been saying. Our city (well i am a blow in) is turning into an us vs them — when it should be just about all of us. When people fuel the fire about rumors it will continue to get uglier and uglier.
Reasonable people can disagree with out mud slinging.

In past posts I have seen and written about everyone being one sided. CC Kaz — this issue comes at a pretty interesting time — don’t you think?
    Who did he piss off?
Has he been charged — or is the court (Lowell Sun) of public opinion doing that for us?

CC Broderick what happended to that one (is he kissing the ring so its not reported or is his father relationship with the emperor of the city the reason its not reported?)
Was the original subpoena at the building dept for his fathers property of which he is the Atty? — Is this mudsling BS or not? Should he be charged?

CC Millinazzo any claffification with the ATM issue and the tax break issue? O’ thats right he was calling as a VP for the bank Pleeeeeaaassse— Ethics Violation? Doesn’t the bank have another VP that could have called?

CM Lynch doesn’t know what the parking Czar is doing??

CM Lynch was/is/thought about spending an extra $200k on Security at the garage — Is that ok? O’ that is right it was not granted and the IG now says it needs to be rebid —
The City was going to rebid anyway — Did the CM get caught in a lie?

Reminds me of the time the CM said he didn’t know they were moving all the cities reserves of $ out of Lowell Banks and then blamed Tom Moses for not telling him — Is he lying?

(I know the answer to that one as a former Chelm Resident)

Now the new one is Frankie is a tax evader and has her Parking tickets fixed by the City Manager? — Is this true or just an interesting time to be brought forward?

Look down river — the us vs them mentality really works for Lawrence.

Continue to let Emperor Wallace quarter back this whole thing and the power he once had will be back. All the City Councilors will check in with the 6 month Emperor (down in FLA the other 6 months — ahh must be a tough life as an overpaid paperboy) to find out how they should vote.

If you don’t think that the Sun has something to do with this — then you do not know their history — if you don’t know the history

Good Luck When it is repeated.

  39. The Mark Says:

Actually the National Enquirer is a credible news source: see Edwards, John sex scandal. Wait who is he again? Everyone sat on that story until scooped by the NE much like the ACORN thing over at Breitbart’s site. The “media” lacks credibilty in alot of peoples eyes now and since you can go to “credible” sources out side the traditional media now the rules of the game has changed. 50 years ago the SUN would have basically dictated who they wanted elected via their coverage. No one would be able to mount a counter attack to refute anything based on coverage.

    Obi One which is it?

#19- “also know as fact (yes, fact) that he pays his sign holders.”

#29- “I had actually commented to people that he must be paying his sign holders. No facts to support it at that time but he had such a committed army of very aggressive sign holders that it just led me to assume that they had to be motivated by something beyond loyalty and friendship.”

So which is it? Fact or speculation based on your admitted dislike for the man?

Now let me be clear- I have NO relationship with CC Kazanjian but I do think that resonable questions need to be asked in the chaos that is leading up to next months election.

Does the FBI have something? Nothing? Does it even matter to voters? I know this much whoever finishes tenth better be ready to step in at a moments notice because I know that most eyes reading this DON’T like CC Kazanjian but this is a small segment of voters in the city. A much larger less blog aware segment looms and to some of them this is all BS cooked up to make their guy look bad right before he gets re-elected.

I think he gets re-elected now if he is forced to resign after the fact we’ll all have to wait and see.

  40. Jack Mitchell Says:

    Ask John Edwards.

  41. Mimi Says:

    Outsider:

Now, who is slinging mud? By the way, one person’s outsider is another’s insider.

In all of your attacks on the. City Councilors, both incumbents and challengers, you do not present a single piece of evidence; you are merely repeating politically motivated rumors that are meant to deflect from the reality we are facing today.

Are you one of those who believes that if an inaccurate statement is repeated often enough, then some people may begin to believe it to be true?

  42. Eleanor Rigby Says:

The National Enquirer is a credible news source!!!! PLEASE!!!
    How’s this for credibility?

    Enquirer Exclusive
TED KENNEDY: “I SLEPT WITH OVER A THOUSAND WOMEN!!”

Maybe something like this is in Campy’s future? Let’s ask, enquiring minds want to know! LOL LOL LOL

  43. outsider Says:

Mimi — you missed the point

    why am I not surprised

  44. outsider Says:

Sorry in case you don’t understand it, try to re-read my comments :)

  45. Matthew Descoteaux Says:

Once again, rumors are being spread about my wife, Franky Descoteaux’s candidacy. This time it concerns parking tickets and taxes. As usual, this anonymous information is incorrect and malicious. Our personal and business taxes are all up-to-date, and have always been.
We have never asked for, nor received special treatment from City Hall regarding parking tickets. I (Matthew) had disputed some tickets attributed to me but were in fact issued to a vehicle that was not mine. The situation was resolved, and I paid the tickets I was responsible for. I have no outstanding parking tickets.

  46. mo Says:

Did anyone catch the city council meeting this week? I was curious to see how AK handled the pressure of an investigation hanging over him. AK did not disappoint, rather than lying low, Mr. Kaz requested the Manager “look into” the parking enforcement around Eliot’s Hot Dogs. Apparently, over a dog Mr. Garside complained that his patrons are being ticketed. He didn’t go into detail, but I imagine that they were either ticketed for letting the meter run out or for parking illegally, either way it seems that our esteemed councilor was directing the City Manager not to ticket. Hmmm… how about this for a suggestion to the parking problem, if his patrons can’t wolf down a hot dog in under two hours, how about the Early Garage? Wasn’t a theme of AK’s concern over the financial success of the garage? Maybe if AK spent more time encouraging the use of the garage rather that looking for ways around paying for parking this “concern” would have a bit more credibility.

  47. joe from Lowell Says:

When nothing comes of this “investigation”

    LOL! Dude, open YOUR eyes!

I defy to name an example of the District Attorney (and now Attorney General) subpoenaing hundreds of records from a City Hall and nothing coming of it?

And what’s with the scare quotes around the word “investigation” anyway? Is a situation in which the Middlesex District Attorney subpoenas thousands of records from City Hall not really an investigation?

I suppose she’s the tool of Kendall Wallace, too. Sigh, if only everyone could be as pristine as Alan Kazanjian and John Cox. Not.

  48. joe from Lowell Says:

Bumper sticker on Gogetter’s car: “I’M FOR CROOX.”

  49. joe from Lowell Says:

Keeping in mind that I’m not an attorney; perhaps the reason nobody is talking about Kevin Broderick in the same breath as Alan Kazanjian is because THERE ISN’T EVEN THE SLIGHTEST EVIDENCE OF WRONGDOING ON THE PART OF COUNCILOR BRODERICK.

    Oh, yeah, that little detail.

  50. openyoureyes Says:

Hey joe nobody said cc Broderick did something wrong but his father sure did. The scandal has been ignored while we continually hear about Sandy Ames and his wrongdoing and because he is a close personal friend of Kazanjian the Scum continually throws it out there under the old adage, throw as much of it against the wall and see what sticks! If the McBee scandal (which I still say is FAR more aggregious) were subject to the same treatment I dare say people would equate wrongdoing by cc Broderick. If you are guilty by association, as most on this blog feel about cc Kazanjian I would dare say you are also guilty by relations.

As for Mr. Lynne once you come out from behind your wife’s skirt you may want to understand that I meant it was curious that he had a copy of a subponea. When he was asked they realized that word would get out and put it on their website before they were scooped. Do you think they wanted to print it on a Tuesday a month before the election.

And Mimi just because you say it does not make it true nor does it constitute evidence. How do I write something and present evidence on this blog? If you want to be Woodward and Bernstein do as they were told follow the money dig into the LHA permit issue.

  51. Kim Says:

“If you are guilty by association, as most on this blog feel about cc Kazanjian”

This is not about guilt by association. Ames was working for Kazanjian on city time and sucking up my tax dollars and the only thing Kazanjian could say was that he was not paying him (No crap we were!) and that he did not know Ames was out pulling permits for him. Do you really think that the DA is just doing this for fun? Kazanjian is an embarrisment to residents and you are not worth comments.

  52. Mimi Says:

    Openyoureyes:

I have to agree with Kim. You are trying to deflect the serious situation CC Kazanjian has found himself in. There is only one individual in this City, whose records the DA has decided to subpoena. You are trying to muddy the waters, and I am not buying it. If you have “evidence,” send it to mimi[at]leftinlowell[dot]com. We’ll scan them and link to them.

Better yet, send it to D.A. Leone’s office.

  53. Mr. T Says:

Kazanjian said “it went without saying” Ames was not doing the errands on work time. Is Chelmsford in a different time zone? If you are a full time employee of the city of Lowell, hold a pert time job for Kazanjian, and sleep away your lunch hours at Kazanjian businesses, just when would not on work time be? Wouldn’t Chelmsford municipal offices pretty much be open when Lowell’s are?

  54. Mr. Lynne Says:

“it was curious that he had a copy of a subponea.”

Reporters find ways to get information. It’s there job. Could be insidious, could be innocent. Without information I (nor you) are in no position to conclude. I’m not a lawyer, but aren’t subpoenas public documents? Was it released in secret? More to the point, the reporter in question can be contacted and asked. If your so bothered by it, please go ahead and ask and report back. In the meantime I won’t lose any sleep.

  55. joe from Lowell Says:

His father’s not on the council.

You’re just shouting “Hey, look over there!” because your sugar daddy is about to get indicted.

  56. openyoureyes Says:

It is my understanding that the DA is very upset about the subponea getting out and is looking into how it could have happened when only city hall had knowledge of the document. MMMMM I wonder how The Scum got their hands on it. Can anyone explain how McBee development buys properties and very easily gets them approved for section 8. Where for art the connection, are there any additional investors?

  57. Mimi Says:

    Open…

Since you seem to know DA Gerry Leone so well, (how else would you know he is upset)maybe you can ask him what this is all about instead of coming on this site and beating the same drum. As Joe said, you are trying to deflect our attention from what is really going on. We are not buying it…so stop trying.

  58. waittilnextyr Says:

Grand jury will be impaneled starting Tuesday morning, so why bother with the speculation now.

  59. openyoureyes Says:

Mimi I am not trying to deflect anything. I don’t like the fact that Ames was sleeping on the job but in my opinion it is a far less serious issue than numerous families living in a property without the proper fire equiptment and inspectional services allowed this to happen. What would the liability have been for the city if God forbid there had ever been a fire or accident and someone were hurt or killed. You can continue to shill for your pet candidates if you want but the FACT remains that this scandal is far more serious and put the city at significant liability.

Mr. Lynne, do you really think Chris Scott would tell me or anyone how he got the document. I wouldn’t waste my cell phone minutes making the call and please tell me how his obtaining the document could be innocent? did he stumble across it in the street? are you really that naive or just stupid?

  60. joe from Lowell Says:

Since you’re so concerned about that possibility, the fact that a major Lowell developer, responsible for hundreds of residential units, has had the gas inspector in his pocket for a couple decades must really keep you up at night.

  61. openyoureyes Says:

Boy joe you are a small angry little man, not to mention foolish. Have there been any charges of violations. You may not like the fact that Kazanjian has torn down some mills and made the properties productive again but perhaps even you would agree that they have been well built and free from any major incidents. I am quite sure he did not have families living in the property for weeks at great risk. But I am sure joe someone like yourself would be glad to see your taxes increase when the multimillion dollar lawsuit comes down when someone is injured as a result of this negligence as long as it is the beautiful people who benefit.

Hey Mimi why are you not admonishing joe for trolling with such a crude and baseless comment, how come he need not offer irrefutable proof as you seem to wish with regard to me. So I guess joe if the facts do not fit your agenda you look the other way. Do you not think the owners of McBee have inspectors in their pocket. How else could these violations occur?

  62. Jack Mitchell Says:

LiL Admin - Please consider, further, your banning policy. openyoureyes does not advance any conversation. This person merely exploits the soapbox provided to disseminate hateful propaganda.

As this is not truly a public place and it is paid for, as well as maintained, privately; there is no mandate to facilitate the stinking garbage to fester and leach out.

The level of conversation that this person provides is readily available in other places. These are places I choose not to frequent as they are nothing short of political pornography.

Again, imo, this is the worst of Lowell politics and I’m asking that you consider its place on LiL.

    Thank you for your consideration,
    Jack Mitchell
