Some of you who do not subscribe to the Sun, either its paper copy or electronic version or purchase the Sunday edition, do not have had an opportunity to read the Sunday Column. In addition to providing us with some inside information, this static blog provides a lot of political rumors, commentary, spin and jabs.
If it were not for the Column, perhaps we may never had known about the on-going drama between the License Commission and Attorney Michael Zaim who was representing the Lowell bar El Rincon. The great majority of us do not have the opportunity to watch that board’s meetings, but thanks to public access television in general and LTC in particular here is the clip that set off Lowell’s latest political drama. You may need a list of the players as well as a short bio in order to understand the dynamics. Also, all Lowell government meetings, including the Boards, are archived on blip.tv.
The times I have watched the Licensing Commission, I have found Mr. [Walter] Bayliss, Chair, to be pleasant, fair, experienced and knowledgeable. El Rincon, the establishment located at 135 Central Street was facing the Commission because the LPD filed complaints of misconduct charges against for the brawl that took place on April 30th which saw every available Lowell police officer responding to the fight.
Gerry Nutter commented on his blog that he believes this was a delay tactic by Mr. Zaim. If it was, he succeeded. The hearing now will be held sometime in August by then the bar/restaurant may no longer be at that location, the paper also reported that they are having problems with their rent payments and their landlord, “the one and only.”
And as far as Mr. Bayliss is concerned, the City is standing by him and all other commissioners who sit on these kinds of boards, as they should. Any active and committed individual will personally know a number of people who come in front of these boards. I think most of them know when they may be facing a possible conflict of interest and take appropriate action by recusing themselves.
My problems with the membership of these Boards is that the City Manager and the City Council have not been able to actively recruit a wider variety of applicants. I was hoping City Councilor Kevin Broderick’s motion of May 18th asking the CM to “report/recommend on adding alternates to City Boards” would provide the opportunity to bring new faces and new ideas to these Boards.
Back to the Sun’s decision of limiting access to The Column. I still do not think it is a good business decision. I would think it attracts people to their site. Maybe down the road when they will follow the model that is coming next year, newspapers charging for selected content.
But for now, if they do not have the mechanism, I would bring it back. First of all, the electronic archives are non-existent and second, blogs cannot link to it, therefore bringing more traffic to the site and most importantly don’t you want to know what people on topix are saying; well maybe on second thought you don’t.

The stark irony of Michael Zaim lecturing ANYone on ethics given who his friends are or have been is just laughable.
Maybe Zaim should recuse himself from representing anyone he has come into contact with or shared a public bathroom with in the last decade? You know, just in the interest of fairness.
Why anyone would hire that guy in the first place is beyond me. His manner of approaching this issue was nothing short of completely rude. It was like he was trying to make Bayliss look bad, and himself look good, it did not come across as him trying to be ethical. Again, look up the dictionary definition of irony…

I’m no lawyer, but I won’t let that stop me. Doesn’t Zaim have the conflict here? Shouldn’t Zaim be forbidden from appearing before these boards? He is a character straight out of the Sopranos. No doubt, over the last administration he’s had private contact with just about everybody on any board on the city. These lawyers who appear before boards should be banned from donating to candidates for elected offices and from representing people they will, no doubt, appear before. He just pissed in his own pool.

correction PC, he “thinks” he’s straight out of the Soprano’s..of course the Soprano’s were much better at what they did vs..well I won’t say in public forum. Conflict? …pay no attention, nuthin’ going on here..move along..the City has it right on this one, bring it to the Bar (and I’m not talking about the SAC).

I know! Really -b, why shouldn’t El Rincon be held responsible for not managing their establishment well and more importantly, providing the venue that got so out of control that it took every cop in the city off OUR neighborhoods! Unfortunately, even if the license Commission comes back with a suspension, El R. will appeal to the state and will likely be overturned. On the state level, the comp. of the ABCC should be changed up a bit.

KRS gets it - this is about setting up an appeal to the courts. Zaim knew his clients were toast with the ABC, so he picked a fight in order to get Bayliss to not only refuse to resign, but hopefully, say something stupid.
The point being to gin up something for the appeal.

no doubt, Joe. Doesn’t this equate to Zaim announcing “I’m dirty”? Because of his political ties, doesn’t this disqualify him from appearing on behalf of any client? It should.

I am a regular watcher of the Lic. Com. and will admit to being “addicted” . I am still puzzled as to why Zaim would ask Bayliss to excuse himself when the land deal was many years ago and favorable to both. At the same time he did not disclose the Weicker connection and neither did Weicker who I often think is too lenient. In all fairness to Weicker, he may not have known all of his contributors. I believe that all of the boards , that don’t already have them , should be expanded to include alternates in case of such future incidnets. Any attorney who has city duties should also be excluded from representing clients against the city.
I heard the scanner call the night of the inciedent and think it is a blooming miracle that they did not have to call for mutual aid. I hope the owner of the property actually does evict them. And the Lic. Com. does need to follow through even if it is closed so that the current manager can not manage another club/bar in Lowell again.
On a side note I think Bayliss is a hoot and would love to be on that board ( but am probably not qualified) .
